On April 15, 2025, the European Union reported a draft Commission Regulation amending Commission Regulation (EU) 2023/1670, which sets out ecological design requirements for smartphones, mobile phones other than smartphones, cordless phones, and tablets in accordance with Directive 2009/125/EC of the European Parliament and the Council.

The draft regulation of the committee revised Commission Regulation (EU) 2023/1670 of June 16, 2023, which specifies the ecological design requirements for smartphones, mobile phones other than smartphones, cordless phones, and tablets. Draft revision content:
Revision 1: Revised the maximum delivery time for providing a range of spare parts to professional maintenance personnel or end users
Commission Regulation (EU) 2023/1670 Annex II requires the provision of a range of spare parts to professional maintenance personnel or end-users, and it specifies the maximum delivery time for these spare parts. There is an error in determining the longest delivery time, which needs to be corrected. Given that this error affects all aspects of the regulation, it is necessary to make the same correction in the ‘longest delivery time for spare parts’ section of each product group. Therefore, it is necessary to revise Section 1.1 (3) of Parts A, B, C, and D of Annex II;
In response to this, the draft proposes revisions:
Related chapters include Annex II Part A section 1.1 (3) (a)(ii), Annex II Part B section 1.1 (3) (a)(ii), Annex II Part C section 2.1 (3) (a)(ii), Annex II Part D section 1.1 (3) (a)(ii). Change the last two years of the obligation to provide spare parts in the original regulations to the remaining time of the obligation to provide spare parts.
Revision 2: Correction section sets different disassembly requirements for different components of the product
Annex II of Commission Regulation (EU) 2023/1670 sets different dismantling requirements for different components of the product. It has been discovered that there is an error in the requirement for replacing display components, which was mistakenly included in two separate parts of the requirement. This error needs to be corrected to ensure clarity and consistency;
Revision 3: Revise the requirements for “disassembly requirements” and “spare parts availability” sections
It is necessary to align the requirements for battery replacement with those applicable to the back cover and back cover components. Given that this error affects all aspects of the regulation, the same correction must be made in the “Disassembly Requirements” and “Spare Parts Availability” sections of each product group.FCC ID
Based on 2&3, the draft is proposed to be revised with the following content:
Related chapters include Annex II Part A section 1.1 (5) (b), Annex II Part B section 1.1 (5) (b), Annex II Part C section 2.1 (5) (c), Annex II Part D section 1.1 (5) (b). Among them, Parts A, B, and D will not apply to battery spare parts in the original regulations, and will also not apply to display components. Part C, Delete section 2.1 (5) (c) of the original regulation Annex II Part C.
Draft revision objectives and reasons:
After the adoption of European Commission Regulation (EU) 2023/1670, certain aspects that need to be adjusted have been identified:
1. Firstly, it is necessary to clarify the requirements for the delivery time of spare parts. The initial regulations stipulated that the delivery time for the first 5 years (5 days) of the obligation to provide spare parts was different from the delivery time for the last 2 years (10 days) of the obligation. However, the obligation to provide spare parts can last for more than 7 years because it is related to the time of product launch on the market.
2. Secondly, the disassembly requirements need to be corrected as the display components were mistakenly included in two separate parts of the requirements.
3. Finally, it is necessary to modify the availability requirements of spare parts to align the replacement requirements of the back cover component with the requirements applicable to the battery.
