Regulatory Updates
According to the temporary final regulations, the data submission period will be postponed to April 13, 2026 (last postponed to July 11, 2025) and will end on October 13, 2026 (last postponed to January 11, 2026). Small manufacturers who only report as importers of goods can extend the reporting deadline to April 13, 2027 (previously postponed to July 11, 2026).
The EPA stated that this extension will give the EPA sufficient time to further develop and test software for collecting data from manufacturers, providing valuable feedback to the EPA, including additional guidance useful for reporting. After the temporary final regulation is published in the Federal Register, a 30 day comment period will begin.
According to the temporary final rule, the last postponed report start date was July 11, 2025, which resulted in EPA not having enough time to test the Central Data Exchange (CDX) application and collect feedback before the submission period began.
According to the temporary final regulations, although the delay in the start time of the submission period has taken effect, EPA will conduct a 30 day public consultation on the reporting period change rules. In addition, the EPA is considering reopening public opinion on other aspects of this rule. The EPA plans to handle comments on both this interim final rule and future proposed rules simultaneously.
